US Judge Orders Release of Abrego Garcia from Immigration Custody
A federal judge has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued detainment lacks lawful basis.
"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," the judge wrote in her ruling.
The situation originates in a mistaken deportation to El Salvador in March, which the government later admitted was an mistake. Following his return to the United States to face alien smuggling charges, he was held in federal detention.
In her decision, the judge noted that the authorities does not have a current removal order, which prevents them from deporting Mr. Abrego Garcia "for now."
Background of the Case
The court proceedings involve disputed claims. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this claim.
He has also entered a not guilty plea to the conspiracy charges, which are part of a separate criminal case in Tennessee.
Terms of Freedom
The judge, who was overseeing his petition to deportation in a federal court, ruled that he must now adhere to the conditions of his bond from jail in Tennessee. This decision shifts his supervision to the Tennessee court.
This decision represents a significant turn in a complicated legal battle featuring claims of mistaken imprisonment and disputed gang affiliations.
