Alina Habba has resigned as the US Attorney for New Jersey. This follows a court battle that challenged her right to occupy the role.
Acceptance of Resignation
The head of the Justice Department, the Attorney General, confirmed her stepping down on the start of the week. She commented that the judicial decision made it impossible for the official to lead the department effectively.
"Do not interpret compliance for surrender," Habba stated. "The effort will now stretch across America."
Legal Background
The departure comes a week after a US appeals court found that she had been serving in violation of the law as the federal prosecutor. This judgment is expected to impact scores of legal proceedings in the Garden State.
The appellate judges said that a interim role that skirted the advice and consent of the Senate violated the Federal Vacancies Reform Act.
Future Role and Reaction
It was also stated that the former prosecutor will stay on at the DOJ as a senior adviser. Habba plans to seek further review of the disqualification, aiming for a different outcome.
In a statement, Bondi argued that judges "cannot be permitted to override the appointment of attorneys tasked with carrying out the primary duty of the administration of prosecuting crime."

The attorney general highlighted her tenure and pointed out that under her leadership, the Newark saw a 20% reduction in offenses. It was also reported that the city of Camden experienced its first summer in half a century without a homicide.
Connection to Donald Trump
Habba, originally became part of Trump's personal legal team in recent years. She went on to acted for her client in his business records case in New York last year, leading to his conviction on 34 counts of falsifying business records.
Earlier, her appointment to the federal prosecutor position, Trump had revealed he was appointing her as his presidential counsellor in a potential future term, calling her as "unwavering in her loyalty" and a relentless legal advocate.
